I agree with you that treating disability related leave should not be
recorded as sickness leave. We changed this policy years a go when I
worked in local government due to legal challenges.
As I remember, the DRC Code of Practice specified that leave that is
related to a disability e.g. check ups, appointments for physiotherapy
or other ongoing assessments should be treated as disability related
leave and not recorded as sick leave.
In addition, when one has an operation that is related to their
disability, it should be noted as disability related sickness,
(separate from other sickness) and this leave should not be taken into
account in normal monitoring processes that can lead to disciplinary
procedures being evoked such as dismissal, giving an unfavourable
reference, choosing those to be made redundant etc.
This can easily be challenged as discriminatory practice.

Dear All,
I hope you are all well. I attended the "from compliance to culture
change - disabled staff working in Lifelong Learning" conference earlier
this week and one of the issues that was raised was about the ways in
which sickness leave and disability leave are recorded and responded to.
The view was very much that disabled staff who take time off because of
their disability or impairment but have to record it as sick leave are
discriminated against.
We do not currently have a separate policy on disability leave - all
sickness and absence comes under the normal sickness and absence policy.
Do any other colleagues have disability leave policies in place and have
they comes across any specific issues?
