There is no common list of the institutional areas where Specific Duties
should be incorporated as such, because institutional functions, policies,
processes, procedures and initiatives that are deemed to be race equality
will vary from institution to institution.
What needs to be impact assessed and monitored (Specific Duties), by racial
group,is the overall implementation of institutional practice. Impact
assessment means assessing the implementation of overall institutional
practice for all who are involved with the institution, finding out whether
it is creating any adverse impact on any racial group and taking the
appropriate action to ensure that institutional practice is good for all.
This is what the RRAA is about, both in letter and spirit. If we can grasp
this, then we will be able to function accordingly.
So what you need to do, in order to find the list that you should impact
assess, is to go back to your Policy and Action Plan and look at what
institutional functions, policies, processes, procedures and initiatives
were deemed to be race equality relevant. Since this is where adverse
detrimental impact is likely to occur, these are what you will need to
impact assess, analyse the outcomes and take appropriate action relative to
the Statutory Code (RRAA) advice.
You will need to link this activity to your Race Equality Policy and Action
Plan, all staff, student and other partners' Communication, Consultation and
Training/Support Strategies. This will also enable the institution to
respond to the vicarious liability and burden of proof requirements of the
RRAA.
Everything that the institution does, since the Act came into being, will
need to show how institutional practice for all, is being implemented in
such a way that it is incorporating the Specific Duties in order to respond
to the three General Duty elements.
This is the reason why the Specific Duties will need to be seen to be
incorporated into those institutional functions, policies, processes,
procedures and initiatives that your Policy and Action Plan qualified to be
race equality relevant, as required by the Statutory Code of Practice.
The links are vital if institutional roles, responsibilities,
accountabilities and liabilities, are to influence institutional
functioning, under the RRAA requirements, into good, anti-racist
institutional practice for all.

because this is an issue that a lot of colleagues are also grappling with.
