The Durant ruling does still apply but it has been altered by FoIA such
that we now have a "two tier" system whereby access to information held by
the private sector is more restricted than to that held by the public
sector.
However, Durant never applied to Social Services records nor to records
relating to Health, Housing and Education matters. Prior to DPA 1998,
access to these was covered by legislation repealed by DPA and they were
categorised as "accessible public records" (S68 & Schedule 12 DPA).
Sorry Tom, it's the hard way - you have the sympathy of one who has been
there and will probably have to go there again.
