One may not like this. But it is real. The people on this list include
sysadmins of some of the largest corporations in the world and some of the
big ISPs too. Posting to the list to explain things will not risk your IP
address being blocked, but you *will* lose your sanity. Go ahead and see
the response you get. BTW they despise the UKIC there, in general.
They are most assuredly vigilante groups. Some have credibility and have
their lists used by decent organisations like Messagelabs, others are a
server in a shack in Russia that no-one even knows is operating! BT
Openworld got Spamblocked by one of those a couple of years back. Some are
well managed others lawless.
You see, and this is the entire point about bad eMarketing, they do not
actually care.
Your analogy with the postman is very different. You see there is a law
about interfering with Her Majesty's Mail. Email is very different legally.
The thing to bear in mind is that epitaph "Here lies the body of Willie Ray
who died defending his right of way". Even if you are in the right on spam
fighter lists, no-one cares. And these people ultimately control your
ability to send email without hindrance.
Oh yes.
Have you ever tried getting off a SPEWS blocklist?
I once shared IP space with an alleged spammer. This was the infamous
www.gdscott.net (The domain was finally blacklisted by its registrar) My
ISP had the responsibility of removing him. They failed to for so long that
their IP address space became increasingly blocked. In the end all their
clients could not email to many domains because the sysadmins at the
receiving ISPs were blocking the IP address of the mail server. The only
course of action open to me was to move ISP totally. I voted with my $$$.
So, this is a fact of life. And because it is a fact of life we have to
work to ensure we do not fall foul of it.

My problem with many of the contributors to NANAE (and UK.legal) is stuff
like this...
"Legal or not has nothing to do with it being spam. It's about consent, a
purchased mailing list cannot have the consent of the listees"... [I thought
about directing this contributor to the IC Guidance, but then feared for my
IP address so didn't - intimidated!]
Just how close to vigilantism is this?
If someone mugged the posty as he left my building and destroyed all my
direct mail ('legal or not'), how long do you think it would take to lock
this person up? Yet we seem to accept that people can do exactly this to
our e-mail marketing.
"I don't care whether that Innovations catalogue is legal, it's not getting
passed me!!!"
A dangerous precedent.
