Police have requested details of all staff who start work between certain
hours in a specific town. They wish to know name, address and DOB...this is
in relation to a serious offence against a child. They basically wish this
information to question if any employees saw anything.
This initially did not come through myself but one of our legal team who
advised our personnel department that under s29 this enquiry was exempt from
the 1st DP principle and that as it is not sensitive data we are processing
we do not need to comply with Sched 3 and should rely on Schedule 2
(condition 5(d)) i.e. that it is necessary for the exercise of a function by
the police of a public nature in the public interest of the child in
question.
This is a serious crime and I do not wish to hinder any enquiry but this
would entail all labourers, home carers etc. I would have thought a
campaign e.g. Did you see anything....Anyway I have requested that the
Police send me the relevant Police form which we use up here stating why
they wish the information etc. which they have done and thus if a member of
staff queries how the Police obtained their details we can provide a copy of
the form explaining the nature of the crime to them.
Seriously though ...I am worried that if another situation arises in this
area are we therefore providing a means whereby the Police can just come in
and obtain any information they want by stating "serious crime". This is
an issue which was raised at my Scottish Information Network meeting and we
are hoping to get a speaker on this topic as several councils are having
similar experiences.
Does anyone have any views on this or similar experiences?
