If Letwin puts out a press release saying "I am pleased to say that the Information Commissioner has concluded that there is no breach of the Data Protection Act" then we all know why.
You can thank Jack Straw for this position, as he was in charge of the FOI Bill. He was also was in charge of the DP Bill for that matter.

If the reports are true, whatever the outcome, Letwin is probably
attempting to ensure that all the constituents correspondence he is
reported to have thrown in the bin was being dealt with fully and meets
the full expectations of his constituents. Only in that way could he
hope to present an argument to them that throwing their letters into a
public waste bin is not the same as posting them to his office. (I'll
forgo the out-basket jokes.)
A strict conclusion that the DP
principles cannot be considered to have been breached in the British
law would provide really damning evidence that the UK DPA is hugely
deficient and how nonsensically organisationally focused Durant was.
Imagine trying to tell somebody that their name, address, and opinions
or complaint are not defined as personal data, and yet the IC has to
apply a strict interpretation given the legal precedence - or does he.
