There seems to be a lot of confusion over whether the USA PATRIOT Act's data access powers represent a breach of EC data protection law. The fact that EU law still apparently recognises Safe Harbor as conferring equivalent adequacy seems to suggest that the US Government's ability to access to personal data doesn't count as a problem. But I did spot that the ICO mentions the Act as something to be taken into account when doing your own assessment of adequacy in his paper on outsourcing for SMEs (but without giving any clue what weight it should be given), even though he still seems to count Safe Harbor as OK. A clear message would be nice...
