That's a common misconception.
However, a pre-ticked opt-in box (aka opt-in scheme) is a completely
different thing to an opt-out scheme - which is where you don't get
asked and are just stuck on the mailing list[1] until you complain after
having got the first email.
[1] If required by law, first being checked against a global "opt-out
list", but such a list does not exist in the UK for email; only phone
and post.
