The "consent to marketing or you don't get your quote/competition entry"
etc. is becoming more widespread. I noticed the other day that one of the
motor breakdown companies uses it.
At least in part I would have thought whether or not it is legitimate
(ignoring whether or not it is good) practice will depend on whether an
organisation is offering a product/service that people have to have and
whether it has a monopoly/near monopoly on that product or service.

I'm not sure it goes further than being a "best practice" not to pre-tick
them. My contention is that most of these are perpetrated by over-enthusiast
young marketing people, who don't fully understand the law, or the
irritation that such things cause.
But there are a few that are more vicious - I've seen sites where they
refuse to continue unless you agree (which probably wouldn't be legal for a
mandatory online competition form, but I bet no-one really knows).

It's the same for multiple orders from the same vendor. I get asked this
every time I buy another low-cost airline ticket from a previous supplier.
Ultimately, you could probably argue that the most recently provided option
wins, but good luck getting that to stick.
