One of the difficulties with such a stipulation under section 11 (even if
the list could be regarded as 'personal data'), is that the section 11 right
(to prevent direct marketing) is exercisable only by the relevant data
subject, and therefore cannot be imposed, per se (in the absence of a
contract), by a list provider.

We had a similar request which , of course, we supplied the data with a
condition that under section 11 of Data Protection Act 1998 the list was
not used for direct marketing. Of course they could use the list with
the occupier.
Just a thought though, could the provision of Reuse of Public Sector
Information Regulations 2005 mean that they would need a licence to use
this list for commercial purposes. Maybe Paul D or someone can advise.
