I think you have to ask them what they are relying on to allow this data to
be passed to them when it appears otherwise prohibited under the DPA 1998,
and that you need to tell them you are willing, but appear to be unable, to
pass them this information.
The UKIC's helpline will be a useful ally to you here. They are
increasingly good. Call them

Subject: [data-protection] Request from Government office for NI numbers
We have a situation here which is causing my head to become very sore (it's
the bashing on the brick wall syndrome I think!!)
I don't know the full details of the situation but as it has been explained
to me - there is a Government incentive to create new jobs in an area where
my company are based in the UK - the company have created the jobs but the
agency are asking for proof of this by requesting the salaries and NI
numbers of the people put in post.
I believe that this is not necessary and the individuals concerned would
need to give their consent for the information to be given. Some of the
jobs were created by us and filled by contract agency people (so we're not
even the data controller of their information).
The Government agency are really quite insistent that they will not take
anonymous data - I am quite insistent that they cannot have NI numbers
without consent.
Is there an exemption which I'm missing ?? Add to this problem the fact
that the agency are saying "when it was started your people said there would
be no problem with giving this information - so why is there a problem now?"
--- If only I could pinpoint who agreed to it !!!
