Section 115 provides the legal ability for public authorities to share
where normally administrative law would have prevented sharing. It does
not provide a compulsion to share, that is an individual decision in
compliance with the DPA.

Subject: Section 115 - Crime and Disorder Act 1998
Dear all,
If invoked, does Section 115 of the Crime and Disorder Act 1998 override
all of the provisions of the DPA? The Act reads:
115. - (1) Any person who, apart from this subsection, would not have
power to disclose information-
(a) to a relevant authority; or
(b) to a person acting on behalf of such an authority,
shall have power to do so in any case where the disclosure is
necessary or expedient for the purposes of any provision of this Act.
[...]
The words 'necessary' and 'expedient' give me pause.
Nevertheless: e.g. If the police want to have access to large amounts of
personal data to establish crime patterns and to generate appropriate
police response(s) to same. Do we just release the data? Or do we need
to seek further data subject consent?
A related concern is consideration of 'personal' and 'sensitive
personal' data.
So, can data controllers be relaxed about Section 115 of the Crime and
Disorder Act 1998 as constituting a legitimate reason to disclose data
without further reference back to the data subject. Or do we need to be
a lot more circumspect.
Many Thanks,
Gerry.
