A member of staff reported a matter concerning a Housing Benefit claimant to
Customs & Excise and they've asked for a witness statement to confirm some
details. They have sent a request under Data Protection, as well as
mentioning Human Rights. There are also some parts of the file which would
be very helpful to Customs, such as bank statements and a statement made by
the claimant at the Enquiry Counter. The Customs Officer stated that these
could be given as intelligence information which they couldn't use but would
assist them. Our Housing Benefit application form does have in its
declaration that we "may give some information to other government
organisations, if law allows this."
Does Section 29(1)(c) cover such a disclosure or is there other legislation
to cover this. Any help appreciated.
