As Guernsey is not an EEA state and has not been added to the approved
list, it does not have to follow the EC directive of the Data Protection
Act 1998.
It is the Guernsey Data Commissioner’s objective to match data protection
in Guernsey with the EC Directive and UK law. The data protection law in
Guernsey is a copy of the 1998 UK Act whilst at the same time the local
commissioner sees as his objective getting Guernsey on the approved list.
That is why his quaint view that even a business e mail address that
identifies an individual is not personal data is of such interest and
concern to many of us in the island.
