I wonder if someone could provide any assistance with the
following query:-
Students who complete an Access application form at
Exeter University are advised in writing that assessed
applications will not be returned to students. If a
student requests a copy of such a form they are simply told
that they cannot have a copy and that it is University
policy not to return or provide copies of assessed
application forms. The assessed forms are of a
confidential nature and contain comments made by the
assessors and in some cases these comments are quite blunt
and might upset a student if seen by him/her.
However, under the new Data Protection Act if a student
requests a copy of the assessed form either via (a) the
Students Loans & Fees Section themselves or (b) the Data
Protection Officer as part of a full subject access
request, will the University be required to disclose this
information to the student?
My feeling is that as the forms/information are
confidential and as it is University policy not to
copy/return assessed forms to students (made clear to
students) it could be argued that the Unviersity would not
need to disclose the information to a student upon request.
But any advice would be greatly appreciated.
