Hi James
As far as I know anyone can make a SAR on behalf of someone else as long
as you have their written authority to disclose to that person. I would
only give what they ask for. If we have a SAR asking specifically for
benefit data we do not search other departments.
Thanks

Subject: [data-protection] SAR from a 3rd party
I have just received a SAR from a claims management company (CMC) acting
on behalf of a data subject and I would like some advice on a problem I
have with it.
The letter asks for some specific information - If we accept the SAR, is
it ok to respond with just the information asked for or do we have to
provide a copy of all data we hold?
The letter encloses an authorisation from the data subject for the CMC
to pursue a complaint on their behalf.
The problem I have with this is that:
a) no complaint has been made (as yet anyway); and
b) if we gave a copy of all the data we hold on the data subject to the
CMC we may be giving them information which has nothing to do with a
complaint. We may potentially hold sensitive personal data about the
individual.
It seems this may be a bit of a fishing exercise and the CMC just wants
a copy of our file to see if there is anything wrong with the advice we
have given.
My thoughts are that I should write back to the CMC saying that until we
receive a complaint, we do not have the authority to deal with the CMC
and that if they want to make a SAR, I require specific authorisation to
that affect.
Does anyone have any thoughts on this?
James
