Are CT giving a list of names and addresses of those in arrears to Payroll
or is Payroll giving an extract of the entire employee file - name and
address - file to CT to check if an employee lives at an address where the
person liable for CT (mum/dad etc) may be in arrears?
Is this an automated process without human intervention?
Not all employees live within an authorities boundaries
Not all employees living within the authorities boundaries will be liable
for payment of CT
CT can demand any information from other billing authorities except info
about the other billing authorities employees.
Regs are silent on whether the same billing authority can use its own
payroll data
The same legal process should be used against employees who are in debt with
CT as any other resident
The legal process requires those in debt cooperate and give income details
of themselves and other family members
Some workers will be under the threshold for attachment of earnings orders
(i.e the stated justification).
Failure to cooperate may indicate Code of Conduct issue - depending on what
your Code says about indebtedness to Council
Is the purpose to ensure payment where they have the means or disciplinary
sanction?
Does telling an employee in advance that they will be treated differently to
other residents (possibly with same earnings) make it fair?
What does 'done properly' mean?

The LGFA 92 does not stop using CT data for collection of Council Tax
although I would have thought that the exemption at S 29 of DPA would apply
( collection of tax) This can be used for trawling but I think you would
have to justify if the use was thought to be excessive.
