I've noticed that an increasing number of organisations are using what appears
to be a standardised Criminal Record Declaration Form, especially in the public
sector. The first question asks whether an individual has "ever been found
guilty by a court of any offence in any country (excluding parking but including
all motoring offences even where a spot fine has been administered by the
police)..
I'm uncomfortable with this question as it stands as it seems to be requiring
disclosure of an excessive amount of information. Surely details of motoring
offences are only really relevant if the position applied for involves driving a
vehicle. And I thought that on the spot fines were civil penalties rather than
the equivalent of a criminal conviction handed down by a court. The form
seems to be requiring diosclosure of more information than would be available
under a Disclosure Scotland, Access NI or CRB Basic check.
Has this form has come out of BS 7858:2006? Does anyone know whether it
has been commented upon or approved by the ICO?
