I agree with Philip, you risk "getting yourself in knots" as in my
opinion this is just not practical - in terms of demonstrating fairness
at any rate. What should be decided is, do we introduce and thereby
provide all people with the option of a recording (which would suffice
the DDA aspect) or do we flatly refuse all and just provide a transcript
- thus by sticking to one or the other prevents any form of alleged
discrimination and provides a clear demonstration of fairness to all. I
happen to think that the former should be introduced, that way all are
included.

But to return to two points.
1. I do not agree with Donald's "realistically, you can't stop an
individual making the recording". The tribunal controls its own
procedures and can just say no.
2. On the DDA issue, as I have discussed with Matt, allowing the
recording would go beyond reasonable provision for the disability. It
would put student in a better position than a non-disabled person who
would not expect to have a verbatim transcript.
