It seems to me that the Tribunal draw a clear distinction between those
core investigatory functions such as benefit fraud where there is a
specific regulatory function, and those functions where Councils are
merely a service provider.
And that RIPA can only be used for the detection of crime where the body
concerned has a specific statutory role in such investigation.
Otherwise any Council could use RIPA to spy on householders who are
putting recyclables in the general waste! And that I think would
disproportionate.
Remember if you've nothing to hide, you shouldn't mind!
