A pre-emptive instruction not to send direct marketing material is certainly
possible. The Act says (s.11): "an individual is entitled ... to require
the data controller ... to cease or not to begin ... direct marketing ..."
The question of whether to add them to your "do not mail" list is then a
practical one: are you likely to capture their details in future for
marketing purposes? do you have sufficient information to ensure that you
suppress the right person? would you be prepared to take the flak if you
inadvertently marketed to someone in future who had used this service?
