I have replied to Tim off list on this one however the debate seems to
be going down "does a councillor need to notify?" I understand a
councillor has three functions, one as a member of a committee board etc
when they are covered by the Council, political activities when they are
covered by the party and rumour has it that some even represent their
electorate when they will need to notify themselves. The ICO has even
provided a template for them to do so. So if your councillor is holding
personal information about a constituent in electronic format and hasn't
yet notified there are committing an offence.
Anyway that's how I see it!!

I asked this question a while ago and unfortunately didn't get many
helpful responses. A lot of replies I got indicated that the
information councillors held was included in the LA notification but of
course it's not. I'm aware that party election canvassing information
should be covered by the relevant political party notification (unless
he/she is an independent) but their own constituency casework should be
notified by each councillor. However, the DP officers in my
neighbouring authorities (except Vale Royal) have not notified their
Councillors' processing but indicated that the council would pay if it
was decided to do so. All of Vale Royal's Councillors have notified and
the council pays their annual fees.
I have been gathering these details so I am armed with comparable
information for my own council to make a decision. Unfortunately our
Chief Executive, Asst Chief Executive and their PA all retired from the
council on the same day last week so no decision has yet been made. My
proposal was to prepare notifications for all elected members and hold
briefing sessions for them about their DP responsibilities and suggest
that the council pays their fees. With the current situation at the top
of the tree I don't know when a decision will be made.
