Data Protection Act and Payslip Advertising
*Q. Do staff have the right to opt out of payslip advertising?*
*A*. Yes. The Data Protection Act gives people the right to object to
their personal information being used for marketing purposes. Employers
are obliged to respect any objections. Under the Act 'marketing'
includes not only the marketing of products or services, but also
broader activities such as the promotion of another organisation's aims
and ideals.
*Q. How can a member of staff opt out of payslip advertising?*
*A*. The payslip has an outer wrapper that includes both a change of
address form and an advertising opt-out form. The form is directly
underneath the front panel of the payslip, which displays the
individual's name. All the member of staff needs to do is tick the box
on this form 'I do not wish to receive marketing inserts with my
payslips', complete their name, pay number and employer, and send the
form to their Payroll Department.
Q. Will staff who opt out of payslip advertising miss important
messages from their employer?
*A*. No. Employers should ensure that when sending important
work-related information out with payslips, the information is manually
attached to the payslips of those staff who have opted out of advertising.
