Perhaps the real thing to consider is: "By defining a backup as grist to
the mill for DPA1998 purposes, do I open myself up to the potentially huge
expense of recovering every conceivable backup of email systems (etc) in
order to conduct a potentially fruitless search?"
It is quite possible to debate one's self into a mighty deep money pit. UBS
and £4.27m is not a road I want to tread at all.

Well I think the whole definition isn't in regards to computers but
information that is being processed by a automated equipments (see below),
such as a tape recorder or computer so as the tape cartridge would have to
be read by the machine I would say this would still not be exempt.
Definition Data means information which:- (a) is being processed by means of
equipment operating automatically in response to instructions given for that
purpose; (b) is recorded with the intention that it should be processed by
means of such equipment;
