One could assume the security arguments are loosing their weight and the
wide implementation of privacy invasive new technology is beginning to cause
the balance of security arguments to favour the individuals caught in those
circumstances. (Or maybe the airport could not get a national security
exemption certificate signed.) Shifting the argument to a generic all
encompassing Customs and Excise purpose could only strengthen those
arguments.
It makes me wonder what purposes the data are used for, who they are
disclosed to and how long the data is retained by those organisations who
may receive them. The existence of any code of practice or management
process is not indicated.
Although compensation is mentioned, no mention is made of adapting fair
practice or ceasing this type of discriminatory conduct, or destruction of
all of the data improperly collected, or informing those whom may have
received the data of the actual circumstances of collection, so they may
take what action may be necessary by them.
As far as I am aware there are no methods for confirming destruction of this
type of material generally collected in this manner and with a reasonable
level of security and tracking of data being required to achieve that, think
other DPA breaches could be hidden in the detail. Whilst SAR may provide
some confirmation, actual disclosures which may have taken place are
generally not at all clear within any response, so the data protections the
legislation provides to the individual to facilitate tracking of their own
data become extremely poor.
