Could anyone give me some advice on this data protection issue:
A pupil is having a Statement of Special Education Needs prepared. Part
of this process is for parents to offer advice relating to the child's
needs and this advice is then appended to the Statement of Special
Education needs which is circulated to parents and the receiving school
when it is agreed.
In this particular case parents are going through what would appear to
be an acrimonious separation. One parent, (parent 1) confirms (as part
of advice) that other parent (parent 2) has been unfaithful and also
makes other allegations about the parent 2 and parent 2's family. These
details have been submitted as part of the "family history" of the pupil
concerned because parent 1 believes this may have an impact on the
child's education needs. Parent 1 making the allegation wants this
information treated in the strictest confidence because parent 2 does
not know that parent 1 knows about alleged infidelity.
Can the allegations by Parent 1 be processed as part of the Special
Needs Statementing process? If so when sending out the final statement
can the advice containing the allegations be withheld or can they be
appended to the Statement even though parent 1 (making the allegation)
has asked for the information to be treated in the strictest confidence.
Messy stuff but the bottom line is that some extremely sensitive
information is involved. Any advice on how to proceed would be most
welcome
