While this may be an FOI question I would like some advice on the data
protection issues involved. I have checked the list archives on this
issue, but nothing related to this issue directly.
I would like to know how list members are handling requests for
information relating to internal inquiries such as internal disciplinary
investigations by third parties. I know there are some exemptions under
FOI, especially s. 40 (Personal Information) and S. 31(2) b (ascertaining
whether any person is responsible for any conduct which is improper).
What Data Protection issues, if any, need to be considered when looking at
a request for information on these matters? I am particularly interested
in any cases where an individual might consent to the information being
disclosed and thus override the concern that the disclosure would cause
them distress (section 10 issues).
I apologise in advance if I have missed an obvious point.
