That does rather complicate matters. I would ask the UKIC for guidance, but
also interpret it as though the giver was in a separate organisation from
the recipient. This UKIC formal advice seems to make matters over
complicated. It has always seemed odd to me that one end was "protected"
and the other end "open", so I have always given references knowing that
they are effectively "open" to the person whose reference it is.
I think that last is the main point, isn't it? If the reference is the
truth, thus not defamation, nor over gilding the reality, then it may as
well be given to the person concerned by the referee as well.

What happens when the giver and receiver are the same organisation? For
example, someone moves from one faculty of the University of Sheffield to
another and a reference is asked for, but the personal file is held by the
same HR department.

There is a formal UKIC view:
An SAR requires the recipient of even a "confidential reference" to divulge
it intact, but not the giver of the reference.
