Likewise, I am very uncomfortable about this. In my opinion, the collection
of ethnicity data requires explicit consent (possibly the Census is an
exception?). Making it mandatory for accessing services is counter to the
definition of "consent". The processing is therefore likely to be in breach
of the First Principle.
We are seeing more and more "function creep" with this. We have been asked
to report on racial/ethnicity, disability, religious beliefs and sexual
orientation. All of these under the guise of Equal Opportunities legislation
and giving the impression it is a legal requirement to obtain the data from
individuals. Only on the sexual orientation question was there a box for
"don't wish to disclose".
