The second point is almost never considered by a person who creates an auto
reply.  They usually simply add their colleagues because they expect the
colleague would have given that permission

I would say that use for marketing would not be a fair use - although it may
happen.  Probably more to the point is - have the other persons whose
details are revealed given their permission for that information to be in
the 'Out of Office' message?

Surely it would.  And yet when they say "Please refer to this person for
that thing and the other person for this thing and, add, and......."
then there is a great temptation do use that extra information for marketing
or other purposes.  And people do.  And this time of year is the time they
do it most because people put a huge amount of information in their auto
replies.

So what then, with the heavily detailed ones?

Surely it would only be fair use to note down any contact details contained
and make a diary note of when the individual is returning.

What fair uses do people believe may be made from any information contained
in any form of auto reply?
 
This is, of course, apart from popping round to burgle you while you are
away!  That one is fair isn't it?
