Some comments on the discussion points raised. 'Personal details to
Insurers'.
1: Re Motor quotations - An insurance contract is based on the principle of
'utmost good faith' Mislead insurer at your risk.
2: The Access to Medical Reports is about Medical 'Reports'. Questions on
quotations are not reports in the same context as far as I recall from my
past researches. The main point about the Medical Reports Act was the right
to see the report prior to the Insurer and veto disclosure if you choose.
(Of course Insurer does not have to enter into a contract where some
information not forthcoming).
The Medical Report Act was 1988 so predated DPA 98. It provided specific
rights before the Data Protection Act was amended in 1998. The 1984 Act
didn't cover paper records. DPA 98 nearly covers everything the the Access
to Medical Reports Act 1988 did but there are still some small differences
so it remains on the statute books.
3: Suggestion Martin made on quotes is valid. A quotes objective is to
acquire the risk rating attributes which insurer needs. Names are not a
rating attribute. However names are usially required when the contract is
being entered into as they identify the specifics of the contract cover ie
which specifc drivers are being covered.
4: Re Les's comment. No not a black list. Its a Database called the Motor
Insurers Database. All Motor Insurers agree to submit to it. Its objective
is to assist with stamping out uninsured driving in the UK. It hold
information all insured drivers/vehicles and is available to the Police for
roadside checks. The Association of British Insurers or your Insurer should
be able to provide full details. And you should find it referenced in FON on
proposal forms or quotation materials insurers provide. Data is submitted
after the Insurance contract is entered into. I undertook a lot of work
around this project when the database was being created a few years back
which included a talk to partcipants Insurers at its development stage about
Data Protection requirements.
There were substantial liasions with the Commissioners office on the project
at the time.

Ok, I don'y know uch about motor insurance, but I do know a little about
life and pensions etc..
The original question by Jim was 'that he was asked for medical details and
details of penalty points on each driver before providing a quotation etc'.
The insurer would need to know the medical condition of his book in order
to assess the risk and likelyhood of these folk having an accident. Fine.
Next is driving convictions. Same here. If a person is hanging by a
thread onto their driving license, would there be a greater chance of them
losing it or another who has no points gaining some. Perhaps that is
another subject. But the insurance company does have a real reason to
process this information.
As for the Employer collecting the information. Either the Er would get
their troops to write in directly (messy) or consolidate the information.
It is likely that the HR / Premises Dept would have a file on the drivers
anyway, which would then come down to P1 when collecting the information.
How about other Acts? On the medical side there would be Access to Medical
Reports Act, however, that would probbaly be more related to L&P rather
than motor. I think there are a couple of Insurance Acts, but I haven't a
scooby what dates, what they refer, etc..
Hey! There are a few more worms left in the bottom of this can!! Would
the insurer have this part of the quotation fully automated? ADM anyone??
