Section 70 FOIA 2(b) reveals the contradiction. A reference is part of
an appointment and under s70 is exempt under FOIA. My own inclination
would be to follow DPA and disclose. Why, because there is no obligation
to withhold under FOIA but a clear obligation to disclose under DPA.
