Hello,
We have received an SAR from a former member of staff, Mr.X who would like
to see his old personnel record. However, he has become aware that there
is a member of staff currently employed in the Personnel section who he
regularly deals now in his new job role. Mr.X is concerned that in making
the SAR, this personnel employee will learn information about him that
could effect their current business relationship. Now, Mr.X knows that use
of this information outside of work would be illegal/immoral, but he
doesn't want this person ever to see the file or even know that it is
there. Mr. X left the employ of the Council in negative circumstances.
Would Section 10, Right to prevent processing likely to cause damamge or
distress apply here? It is just in regards to this one current member of
staff.
The SAR is on hold (at Mr.X's request) until I look into this, but I am
unsure what to do next.
Any advice would be greatly appreciated.
