Can you help? Based upon an point made on our Intranet discussion board (as
follows) -
'When correspondence is received in the Chief Executives (CEs) Office from
an MP that relates to a tenant, it seems to be the norm to pass this to the
department concerned to draft a response for the CEs signature.
In light of the provisions of the Data Protection Act, the fines for non
compliance, and all the mandatory training that C33 are providing, we need
to be assured that the Chief Executives Office have obtained the necessary
authorisation from the tenant for the disclosure of their information to a
third party? This comment is made as I note that I have received a number
of responses to deal with where no authorisation from the tenant is
attached'.
Now, I have just come out of a quick meeting with the Chief Executive
regarding according to him -
'we need to decide how to proceed in alerting MP's etc to the fact that we
need permission from tenants to give information out, without alienating
the MP's and giving them the perception that we are reluctant to give out
information. To this end, he would like to be clear on what the legal
requirements are'.
Apparently we have been dealing with DP requests from MPs for years without
asking for consent from the relevant tenant. The CE believes that should we
start to ask for consent from the MPs, they will start to say that we are
purposely using blocking tactics, or start to fly the 'I am an MP, it does
not apply to me!! flag', etc.
Any Ideas as to how to get round this. What is done in your organisation?
How do I succinctly and very easily get MPs to ensure that a copy of tenant
consent is sent to us / attached before the CE can deal with a query?
