It gets so silly. People either want to receive stuff or they don't want
to.
If they feel in any way cheated they will simply refuse to do business with
you (best case) and report you for spamming (worst case).
We spend a lot of time on our own training courses educating those who want
to "sneak round the rules" that they may end up lawful, they won't end up
loved. We'll be doing this again at the workshop we're running for the BSI
in October (see http://www.marketimprove.com/smart/BSIdp2004/flyer01.html
and no, I'm not going to go all commercial and plug it hard.) And we'll
meet those again who want to weasel through.
The whole point is "no-one buys from a weasel". So a clear opt in is
essential.
To give you an example, we released our Data Protection Library a couple of
months back. At that point it had totally ad lib access. We now ask a
small "fee". Not monetary. We ask for permission to hold the email address
of the visitor prior to serving the page, plus permission to send them
relevant information by email. It's clear, simple, and presented in a
straightforward manner. Anyone who cares to may pop over to
http://www.marketimprove.com/dataprotection/ and see what I mean. And they
are at total liberty not to participate at all, or to change their minds
later. No weaselling, just a simple bargain.
I'd love to know more about the talk you gave? Probably we all would.
