Whilst the assumption of purpose fits in with the described circumstance,
could the photograph equally have been for the:-
police intelligence systems;
proprietor of the premises outside of which the car was parked to enable
them to take civil legal action to recover damages;
media, who were running a story about illegally parked cars and had promised
to pay the traffic warden for photographs of difficulties experienced;
a personal diary;
or any one of many other conceivable purposes.
Like all working circumstances, clarity of what conduct to follow within the
limits of the time paid for by the employer is an important element of
defining legitimate purposes. But, like the limits of the time paid for by
the employer, that can be a perceptual variable.
