I have had a protracted debate with a group of privacy activists about
these issues and the conclusion we came to was that the Privacy
Directive was flawed in that it should have said "*express* prior
consent" in Article 13.1, then everyone would have to have ticked a box
to permit any of these things to happen.
At the time, we (lobbying for the good guys) were all rather distracted
from this "detail" by the wider issue that we only got *any* kind of
opt-in by the skin of our teeth, as the marketing people prefer a system
such as there is for telephone and post, where you are allowed to send
anyone anything, unless they add their name to a central register of
objectors.
There are many reasons, which I won't bore everyone with now, why that
approach doesn't work *at all* for email.
