An interesting finding that an individual publishing a web page on a local
server on the internet does not constitute a trans-border data flow, but
does fall within the context of the directive. This judgement seems to
start a process of logically defining responsibilities of the state, the
data controller and ? data processor with regard to internet trans border
data flows. Sadly questions of appropriate security were not raised, which
may have provided some answer. Also sensitive personal data relating to
religion were not directly addressed.
If no trans border data flow occurs when publishing on the internet in the
circumstances described in the case (onto a local server), could this lead
towards more use of localised ISP service providers and servers? Will
businesses, by preference, go local to provide themselves with the defence
provided by this case?
At a simplistic internet user level, What mechanisms exist which allow you
to become aware of where the page you are downloading is coming from every
time you load a page, and if that page contains personal/sensitive personal
data before you access it?
