If you are a Government body or NDPB this should therefore be answered in the context of the Code of Practice on Access to Government Information at the moment, or Freedom of Information legislation from Jan 2005.
It will also depend what information about responding to enquiries you put in your Publication Scheme (again if you are a public body on the Lord Chancellor's list).

No rights for the next-of-kin, no protection for the data of the
deceased. (Under DPA anyway). So you can do whatever seems correct to
you without the DPA affecting you.
