Durant - v - Financial Services Authority
The Information Commissioner is currently considering the judgment of the Court of Appeal (8 December 2003) in this significant case with a view to producing a considered statement by the middle of next week.
It is clear that the judgment has implications for us in terms of the scope of data protection legislation and it is helpful that we have the Court's view on such a central and complex issue as the meaning of "personal data", the focal point of the legislation. To the extent that the judgment provides clarity on this issue, and reiterates the fundamental link between data protection and privacy rights, the Commissioner welcomes it.
Following our consideration of the judgment and its effect on interpretation of the legislation the office will be undertaking a review of its guidance in the New Year.
