Shepway District Council and the City of London Corporation have sought
counsel on some of the issues raised in the PIU report. In essence, their
QCs believe, much of the data sharing would be unlawful. In their view, even
the sharing of new addresses, even with consent, could be ultra vires
(outside legal powers).
Some councils are already sharing data through one-stop-shops and single web
pages on their "e-government" websites. Others are waiting for local
government legislation to be amended to allow the data sharing with consent
but this is not a priority for government, apparently.
Pages 20-23 of Government Computing Dec 2002 has the details.
Any thoughts on how the e-government targets can be met without this legal
wrangle being sorted out?
