This was posted on the data-protection list last week. Apologies to those of
you who have already seen it.
Interestingly the Code for retention of data applies to communication
service providers who provide a "public telecommunication service" as
defined by Section 2 RIPA. For the Privacy and Electronic Communications
Regulations the "communications provider" definition is taken from the
Communication Act 2003 section 405, a much wider definition.
It could be that the Code on retention of data will not apply to
Universities/FE whereas the Privacy regs will. Anyone else have any view on
this?
