Yes! The issue is not about when you assess but about how
you use the information. IMO you would clearly be
contravening the law if you refused a student a place on
the grounds of the cost of their support. They could (and
should) take you to court and demand that you provide that
the Institution could not afford this.
I'd advise your Institution not to go down this route!
