Is it Friday or April 1st? The cameras that are used for moving traffic
violations are under the control of the police, not local councils. It may
well be "ultra vires" if the council used the cameras for this purpose and
the DPA issues would not enter into it. If CCTV camera footage was
requested
by the police who were chasing an individual and they had reason to believe
he/she breached a red light they could apply under s29. If the council did
not believe the footage would assist in a prosecution they may well refuse
the request. If a crime is serious enough, such as violent attack,
robbery,
etc., then of course the council may well proffer the tape for evidential
purposes. But if every council adopted a policy of informing the police
every time someone parked on a double yellow line, jumped a red light or
ran
a wheel of their car onto a pavement, the police would soon tell them to
stop!
