From many perspectives it seemed to be normal data protection work, for
which the DPA 1998 in all its detailed intricacies has tried to address, and
which 95/46/EC can avoid by necessarily being less prescriptive.
If it is not possible to determine the reason data was collected, apply the
principles and correct degree of security, access and use, what are list
members doing at all? It does seem though that formalising those
determinations into a computer system adds a rigidity which people do not
necessarily like, even if they have previously agreed to those
determinations.
Or perhaps it should be left completely to individuals to protect themselves
and their information, trusting nobody, only giving data when necessary, and
then providing false made up information merely sufficient to gain the
service required. A scenario such as that would certainly save much
heartache for organisations.
