If you look at the Lancaster DPA project they "seem" to be saying that you
can place graduation stuff on the web on the basis of an optout. eg. opt out
from grad lists. ditto for webcam stuff if "faces are not readily
recognisable".
I take that to mean if you use a 50 UKP web cam taking 5 shots a minute of
dubious quality you are probably OK. If you use a proper camera ... IMHO ...
you'll be breaking the law. What are you going to do, tell people not to
graduate in person if do not want to be on the internet?
The whole idea of putting student details on the web with opt-out centres
around the argument of "legitimate interests of the data controller". I
don't buy that we can argue for "legitimate interests" to put student
details on the web. Of course, I will loose the argument.
