Morning All
A few questions following on from this thread:-
Does the citizen need to have been informed of the potential uses at the
time the personal data was colledted by council tax registration officer to
satisfy principle 1?
Apart from the 'crime & taxation' exemption and disclosures required by law
(under enactement, court order, etc.) does anyone know of other grounds
available for councils to disclose internally?
There's a major conflict between the LGFA & DPA and requirements to obtain
best vale, for 'joined up' working, promotion of well-being, etc. much of
it requiring development of a strategy for action without actually giving
councils regulatory authority.
So environmental health / social care / housing need information to
establish ownership / occupation of properties but can't use council tax
because the disclosure isn't required by law nor are they actually trying
to prevent a crime.
Can we look to article 8 of Human Rights Act which allows a public body to
interfere with a citizen's right to private & family life if the aim is
(for example) public safety, protection of health & morals, protection of
the rights & freedoms of others?
Does anyone know about any action taken by OIC against councils for
breaches in relation to council tax register?
Has anyone obtained Queen's Counsel's opinion on the secondary use of
council tax data (other than Poole Council, who obtained advice conflicting
with OIC)?
