Hi folks
Have now spoken to the Commissioner's Office and as you have already pointed
out - even if the Consultant/GP has died or has gone away I still have to
get the opinion of someone equally qualified to advise me whether I can
disclose the information to the data subject. As the Council actually holds
the information on file I have a duty to take the above action.
I think I shall take your advice and write to the gentleman concerned and
explain what I am doing just in case it takes longer to get any responses.
Apparently this is stated in the Medical Statutory Instruments....
Will let you know if I come across any problems ...that's if I'm not in jail
(ha ha)...
