Hi Again
From 30 September 2002 we need to notify any "qualifying occupiers" in
dwellings if we serve a Notice of Proceedings on a tenant. The notice is
served if the tenant has rent arrears and could lead to eviction. This
information can be obtained from the Benefit Records but we are moving over
to a Housing Association from 30.09.02 and are acting as data processors for
them. The current contract we have signed up to is that we the Council
would in fact continue to serve the Notices.
Can we still use the Housing Benefit records as SBHA are a completely
different organisation? We are going to continue to accept rents for these
tenants as well as dealing with housing benefits claims and thus why we
would be aware of any arrears etc. Qualifying Occupiers is people over 16
years and would in fact be homeless.
Can we still do this?
