I've just had a useful conversation with the OIC on the likelihood of
decisions over the adequacy of Data Protection legislation in overseas
countries.
List devotees will know that Hungary and Switzerland were deemed OK ages
ago, and Canada is half-way. Its legislation will eventually apply
adequately to Canadian statutory and commercial organisations, but
apparently not to voluntary organisations.
The current situation with others I've just been discussing is:
Australia: has legislation but it only applies to Australian citizens, so no
chance of being adequate.
New Zealand: a decision on adequacy (presumably favourable) expected very
soon.
Argentina: pressure from Spain for a decision on adequacy.
Jersey, Guernsey and Isle of Man (outside the European Economic Area and
therefore not automatically OK): decision on adequacy expected next year.
Guernsey already has legislation on the lines of the UK's 1998 Act and the
other two are in the process of legislating.
Nothing else appears to be in the offing. Hope this is helpful.
